Terms & Conditions
These terms and conditions govern the relationship between AV Tech Smart Solution Pvt. Ltd., an IT recruitment and staffing company, and its clients regarding recruitment and staffing services. By engaging in any business transaction or utilizing any of the services provided by the provider, the client agrees to be bound by these terms and conditions.
Service Provision
AV Tech offers recruitment and staffing services for IT-related positions as agreed upon in the service agreement or job order.
The client agrees to cooperate with the provider by providing accurate and complete job descriptions, relevant candidate criteria, and necessary access to conduct the recruitment and staffing process.
The company may engage third-party vendors or subcontractors to assist in delivering the services, provided that the client’s interests and privacy are protected.
Fees
The service agreement or job order must include information about the company’s fees for recruitment and staffing services.
The client agrees to pay the company per the service agreement or job order conditions. When a candidate receives the job successfully, payment terms are typically invoiced, and the client will have to make payment within the period stated in the invoice.
In addition to the agreed-upon service fees, the client is also responsible for paying any applicable taxes, duties, or levies imposed by relevant authorities.
Confidentiality
Both parties agree to keep any proprietary, sensitive, or confidential information shared during the recruitment and staffing processes strictly confidential.
The company takes reasonable precautions to prevent unauthorized access, loss, or damage to the client’s data. However, the provider is not liable for security breaches that are beyond its reasonable control.
The provider shall conduct a thorough selection process to identify suitable candidates for the client’s job requirements. However, the provider does not guarantee the suitability or performance of any candidate placed with the client.
AV smart tech verifies the candidate’s qualifications, experience, and references to the best of their ability. However, the client remains responsible for conducting background checks and verifying the candidate’s suitability for the job.
The client shall make the final job offer to the selected candidate. AV Tech shall never be liable for negotiations or communications between the client and the candidate.
AV Tech guarantees it will use reasonable efforts to provide recruitment and staffing services following industry standards.
The Client certifies that it has the proper authority and rights to hire the chosen candidate and select the Provider for recruitment and staffing services.
AV Tech shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the services, even if the company has given notice of the possibility of such damages.
Either party may terminate this agreement for convenience by providing written notice to the other party.
Either party may terminate this Agreement if the other party breaches any material provision of this Agreement and fails to remedy such breach within a reasonable period after receiving written notice of such breach.
This agreement is governed by and construed by the laws of the United Kingdom.
The courts in the United Kingdom shall have exclusive jurisdiction over any disputes arising out of or related to this agreement.
This agreement represents the parties’ complete understanding of the subject matter herein and supersedes all prior agreements, representations, or understandings, whether oral or written.
By engaging in the company’s products and services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
